Terms of Use - Sleepless Tradesman

1. Acceptance of Terms

Welcome to Sleepless Tradesman. These Terms of Use ("Terms") constitute a legally binding agreement between you and Sleepless Tradesman ("we", "our", or "us") governing your use of our mobile application and web service (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of Service

Sleepless Tradesman is an AI-powered business assistant for tradespeople. The Service provides tools for job planning, cost estimation, quote generation, invoice creation, photo analysis, and regulatory compliance guidance. The Service uses artificial intelligence, including Anthropic's Claude AI, to power its assistant features.

3. Account Registration

To use the Service, you must create an account. You agree to:

Be at least 18 years of age
Provide accurate and complete information during registration
Maintain the security of your account credentials
Notify us immediately of any unauthorised use of your account
Accept responsibility for all activities that occur under your account

4. Subscription Plans and Billing

Sleepless Tradesman offers a free tier and paid subscription plans. Paid plans include the Starter plan and Premium plan, both offered as monthly auto-renewable subscriptions.

4.1 Free Tier

The free tier provides limited access to the Service with a restricted number of AI messages per month.

4.2 Auto-Renewable Subscriptions

Paid subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the applicable subscription fee at the beginning of each billing period.

4.3 Apple App Store Subscriptions

If you subscribe through the Apple App Store, the following terms apply:

Payment will be charged to your Apple ID account at confirmation of purchase.
Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period at the current subscription price.
You can manage your subscriptions and turn off auto-renewal by going to your Account Settings on your device after purchase.
Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

Apple App Store subscriptions are also subject to Apple's terms and conditions. Please refer to Apple's Licensed Application End User License Agreement for additional terms.

4.4 Web Subscriptions

If you subscribe through the web, payment is processed securely through Stripe. You can manage your billing and cancel your subscription at any time through the billing settings in the app.

4.5 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to your paid plan features until the end of your current billing period. No refunds will be provided for partial billing periods.

5. Acceptable Use

You agree not to:

Use the Service for any illegal or unauthorised purpose
Abuse, harass, or harm other users of the Service
Attempt to gain unauthorised access to the Service or its systems
Use automated methods to scrape, crawl, or extract data from the Service
Interfere with or disrupt the integrity or performance of the Service
Impersonate any person or entity or misrepresent your affiliation
Share your account credentials with others or allow multiple people to use your account
Use the AI features to generate harmful, misleading, or fraudulent content

6. Intellectual Property

The Service, including its design, features, and content, is owned by Sleepless Tradesman and is protected by intellectual property laws. You retain ownership of all data you input into the Service, including job details, client information, quotes, and invoices.

You grant us a limited licence to process your data solely for the purpose of providing and improving the Service.

7. AI-Generated Content Disclaimer

The Service uses artificial intelligence to generate job plans, cost estimates, material lists, regulatory guidance, and other content. While we strive for accuracy, AI-generated content is provided for informational and guidance purposes only.

AI-generated estimates may not reflect actual costs in your area or for your specific circumstances.
Regulatory compliance guidance is for reference only and does not constitute professional legal or building regulation advice.
You are responsible for verifying the accuracy of all AI-generated content before relying on it for business decisions.
AI-generated content is not a substitute for professional advice from qualified surveyors, architects, engineers, or legal advisors.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

10. Account Deletion

You may delete your account at any time through the Settings page in the app. Upon account deletion, your personal data will be removed in accordance with our Privacy Policy. Active subscriptions should be cancelled before deleting your account.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
